Les présentes Conditions Générales d'Utilisation (ci-après « CGU ») régissent l'utilisation de l'application mobile Octoscroll (ci-après « l'Application »), éditée par Octoscroll.
En créant un compte ou en utilisant l'Application, vous acceptez sans réserve les présentes CGU. Si vous n'acceptez pas ces conditions, veuillez ne pas utiliser l'Application.
Pour les utilisateurs iOS, les présentes CGU incorporent le Contrat de Licence Utilisateur Final (EULA) standard d'Apple, disponible ici : EULA.
Octoscroll est une application de bien-être numérique qui vous aide à réduire votre temps d'écran. Elle permet de :
L'utilisation de l'Application nécessite la création d'un compte. Vous pouvez vous inscrire via :
Vous vous engagez à fournir des informations exactes lors de la création de votre compte et à les maintenir à jour.
Vous êtes responsable de la confidentialité de vos identifiants de connexion et de toute activité réalisée depuis votre compte. En cas d'utilisation non autorisée de votre compte, vous devez nous en informer immédiatement via le formulaire de contact.
Vous pouvez supprimer votre compte à tout moment depuis les réglages de l'Application. La suppression entraîne l'effacement définitif et irréversible de toutes vos données associées (profil, progression, préférences). Les données de temps d'écran stockées localement sont supprimées lorsque vous désinstallez l'Application.
En créant un compte, vous acceptez de recevoir des communications de notre part, notamment pour :
Ces communications reposent sur notre intérêt légitime à améliorer nos services et à informer nos utilisateurs de nos créations. Vous pouvez vous désinscrire à tout moment en cliquant sur le lien présent dans chaque email. La désinscription n'affecte pas le fonctionnement de votre compte ni les emails strictement nécessaires au service (confirmation du compte, réinitialisation de mot de passe, etc.).
L'accès aux fonctionnalités d'Octoscroll est proposé via un abonnement Premium auto-renouvelable, disponible en formule annuelle (précédée d'une période d'essai gratuit) et en formule mensuelle. Le détail des fonctionnalités, la durée de l'essai et le prix applicable sont présentés clairement dans l'Application avant tout achat.
Les abonnements sont traités via les plateformes de paiement intégrées :
La gestion technique des abonnements est assurée par RevenueCat. Les prix affichés incluent les taxes applicables et sont indiqués dans la devise locale de votre store. Le paiement est débité sur votre compte Apple ou Google à la confirmation de l'achat.
Les abonnements sont renouvelés automatiquement à la fin de chaque période de facturation, sauf résiliation au moins 24 heures avant la fin de la période en cours. Pour résilier :
La résiliation prend effet à la fin de la période en cours ; vous conservez l'accès aux fonctionnalités Premium jusqu'à cette date. Toute partie non utilisée d'une période d'essai gratuit est perdue si vous souscrivez un abonnement payant.
Les demandes de remboursement sont gérées par Apple ou Google selon la plateforme utilisée, conformément à leurs politiques respectives. Octoscroll ne traite pas directement les remboursements.

Les questions de quiz sont fournies à des fins d'apprentissage et de divertissement. Malgré nos efforts, nous ne garantissons pas l'exactitude ou l'exhaustivité de chaque question. Vous pouvez nous signaler une question au sein de l'Application ; ces signalements nous aident à améliorer le contenu.
Les questions de quiz proviennent de l'Open Trivia Database(opentdb.com), mise à disposition sous licence Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0). Ce contenu demeure soumis à sa licence d'origine.
L'Application, son design, son code source, ses logos, sa mascotte, ses quiz et son contenu sont la propriété exclusive d'Octoscroll et sont protégés par les lois sur la propriété intellectuelle.
L'utilisation de l'Application vous confère un droit d'usage personnel, non exclusif, non transférable et révocable. Vous ne pouvez pas :
Nous nous efforçons d'assurer la disponibilité de l'Application 24 heures sur 24, 7 jours sur 7. Toutefois, l'accès peut être temporairement interrompu pour des raisons de maintenance, de mise à jour ou en cas de force majeure.
Nous nous réservons le droit de modifier, suspendre ou interrompre tout ou partie des fonctionnalités de l'Application à tout moment. En cas de modification substantielle, nous vous en informerons dans un délai raisonnable.
L'Application est fournie « en l'état ». Dans les limites autorisées par la loi :

Vous pouvez cesser d'utiliser l'Application et supprimer votre compte à tout moment, sans préavis ni pénalité.
Nous nous réservons le droit de suspendre ou de résilier votre compte en cas de :
En cas de résiliation pour violation des CGU, nous vous en informerons par email en précisant les motifs. Vous pourrez contester cette décision en nous contactant.
Les présentes CGU sont régies par le droit suisse.
En cas de litige, nous vous invitons à nous contacter en premier lieu pour tenter de résoudre le différend à l'amiable. À défaut d'accord amiable, les tribunaux compétents seront ceux du canton de domicile du défendeur ou du canton dans lequel le consommateur a sa résidence habituelle, conformément au droit suisse.
Nous pouvons modifier les présentes CGU à tout moment. Les modifications entreront en vigueur dès leur publication dans l'Application.

These Terms of Use (hereinafter the "Terms") govern the use of the Octoscroll mobile application (hereinafter the "App"), published by Octoscroll.
By creating an account or using the App, you fully accept these Terms. If you do not accept these terms, please do not use the App.

Octoscroll is a digital wellbeing app that helps you reduce your screen time. It allows you to:
Using the App requires creating an account. You can sign up via:
You agree to provide accurate information when creating your account and to keep it up to date.
You are responsible for the confidentiality of your login credentials and for all activity carried out from your account. In the event of unauthorized use of your account, you must inform us immediately via the contact form.
You can delete your account at any time from the App settings. Deletion results in the permanent and irreversible erasure of all your associated data (profile, progress, preferences). Screen time data stored locally is deleted when you uninstall the App.
By creating an account, you agree to receive communications from us, in particular to:
These communications are based on our legitimate interest in improving our services and informing our users about our creations. You can unsubscribe at any time by clicking the link in each email. Unsubscribing does not affect the operation of your account or the emails strictly necessary for the service (account confirmation, password reset, etc.).
Access to Octoscroll's features is offered via an auto-renewable Premium subscription, available as an annual plan (preceded by a free trial period) and a monthly plan. Details of the features, the trial duration and the applicable price are clearly presented in the App before any purchase.
Subscriptions are processed via the integrated payment platforms:
Technical subscription management is handled by RevenueCat. Displayed prices include applicable taxes and are shown in the local currency of your store. Payment is charged to your Apple or Google account upon confirmation of the purchase.
Subscriptions renew automatically at the end of each billing period, unless cancelled at least 24 hours before the end of the current period. To cancel:
Cancellation takes effect at the end of the current period; you retain access to the Premium features until that date. Any unused portion of a free trial period is forfeited if you purchase a paid subscription.
Refund requests are handled by Apple or Google depending on the platform used, in accordance with their respective policies. Octoscroll does not process refunds directly.

Quiz questions are provided for learning and entertainment purposes. Despite our efforts, we do not guarantee the accuracy or completeness of every question. You can report a question to us within the App; these reports help us improve the content.
Quiz questions come from the Open Trivia Database (opentdb.com), made available under the Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0) license. This content remains subject to its original license.
The App, its design, source code, logos, mascot, quizzes and content are the exclusive property of Octoscroll and are protected by intellectual property laws.
Use of the App grants you a personal, non-exclusive, non-transferable and revocable right of use. You may not:
We strive to ensure the App's availability 24 hours a day, 7 days a week. However, access may be temporarily interrupted for maintenance, updates or in cases of force majeure.
We reserve the right to modify, suspend or discontinue all or part of the App's features at any time. In the event of a substantial change, we will inform you within a reasonable time.
The App is provided "as is". To the extent permitted by law:

You can stop using the App and delete your account at any time, without notice or penalty.
We reserve the right to suspend or terminate your account in the event of:
In the event of termination for violation of the Terms, we will inform you by email, specifying the reasons. You may contest this decision by contacting us.
These Terms are governed by Swiss law.
In the event of a dispute, we invite you to contact us first to attempt to resolve the matter amicably. Failing an amicable agreement, the competent courts shall be those of the canton of the defendant's domicile or of the canton in which the consumer has their habitual residence, in accordance with Swiss law.
We may modify these Terms at any time. Changes take effect upon their publication in the App.

Sie können Ihr Konto jederzeit in den Einstellungen der App löschen. Die Löschung führt zur endgültigen und unwiderruflichen Entfernung aller zugehörigen Daten (Profil, Fortschritt, Präferenzen). Lokal gespeicherte Bildschirmzeitdaten werden gelöscht, wenn Sie die App deinstallieren.

Diese Mitteilungen beruhen auf unserem berechtigten Interesse, unsere Dienste zu verbessern und unsere Nutzer über unsere Produkte zu informieren. Sie können sich jederzeit über den Link in jeder E-Mail abmelden. Die Abmeldung beeinträchtigt weder den Betrieb Ihres Kontos noch die für den Dienst unbedingt erforderlichen E-Mails (Kontobestätigung, Passwort-Zurücksetzung usw.).
Der Zugang zu den Funktionen von Octoscroll wird über ein automatisch verlängerbares Premium-Abonnement angeboten, verfügbar als Jahresabonnement (mit vorangehender kostenloser Testphase) und als Monatsabonnement. Die Details der Funktionen, die Dauer der Testphase und der geltende Preis werden vor jedem Kauf klar in der App dargestellt.
Abonnements werden über die integrierten Zahlungsplattformen abgewickelt:
Die technische Verwaltung der Abonnements erfolgt durch RevenueCat. Die angezeigten Preise enthalten die geltenden Steuern und werden in der lokalen Währung Ihres Stores angegeben. Die Zahlung wird bei Bestätigung des Kaufs Ihrem Apple- oder Google-Konto belastet.
Abonnements verlängern sich automatisch am Ende jedes Abrechnungszeitraums, sofern sie nicht mindestens 24 Stunden vor Ablauf des laufenden Zeitraums gekündigt werden. Zum Kündigen:
Die Kündigung wird zum Ende des laufenden Zeitraums wirksam; bis zu diesem Datum behalten Sie Zugriff auf die Premium-Funktionen. Ein nicht genutzter Teil einer kostenlosen Testphase verfällt, wenn Sie ein kostenpflichtiges Abonnement abschliessen.
Rückerstattungsanfragen werden je nach genutzter Plattform von Apple oder Google gemäss deren jeweiligen Richtlinien bearbeitet. Octoscroll bearbeitet Rückerstattungen nicht direkt.
